European campaign against reactor lifetime extensions

In the last few years, nuclear energy is more and more often framed as possible solution to climate change. It is receiving positive coverage in the Netherlands as part of a narrative as a potential safe and clean alternative to fossil fuels. This renewed attention for nuclear energy has led some people to think that building new nuclear power plants is the answer to all climate change. A closer look will most often lead to other conclusions, but it is a fact that nuclear energy seems to be back on the agenda.

In the upcoming months we will start a discussion on climate change and nuclear energy. The main goal is to meet with a new and younger audience and talk with them about the issues.  Instead of reacting to articles in the media, which frame nuclear energy as positive, we will proactively tell our side. Renewed attention for the arguments is necessary to shift the debate to a more green and sustainable direction.  In March and April we will have meet-ups in a number of cities.

We will use Sunday April 26th ‒ the 34th anniversary of the Chernobyl accident – to protest against the lifetime extension of nuclear power plants. The peak of building nuclear power plants was in the seventies and eighties, which means that quite a number of them are now facing their 40th anniversary. In Europe about one-third of the operational nuclear reactors are older than their technical design lifetime. While most of the first generation of reactors have been closed down, the second generation of reactors are largely still operational. And only a few of those reactors are likely to be closed down in the near future.

In the Netherlands, the Borssele nuclear plant almost silently got permission to continue operating until 2033, which would make it a 60-year-old plant. On April 26th, there will be a protest-meeting against this lifetime extension at the site of Borssele.

It is the aim of WISE to broaden the campaign to a European level. It would be a strong signal to politics and the public if there are demonstrations at various nuclear sites on April 26th. Already we asked several groups in Europe to join.

Belgium confirms nuclear phase-out by 2025, but extends lifetime of Tihange-1

On July 4, the Belgian government finally took a decision about the fate of nuclear power. According to the 2003 nuclear phase-out law, all seven PWR's (4 at Doel and 3 at Tihange, with a total of 5,900 MW) should be decommissioned after 40 years of operation. In 2015, the three oldest reactors Doel-1, Doel-2 (both 433 MW) and Tihange-1 (900 MW) will reach the age of 40. The four other reactors are scheduled to be decommissioned between 2022 and 2025. Today nuclear power produces 54% of the country's electricity.

In the governmental agreement of Decem-ber 2011, the majority parties agreed to respect “in principle” the 2003 nuclear phase-out law, but the closure of the three oldest reactors in 2015 would  be subject to an “equipment plan” about the security of supply. At the end of May, the state secretary for Energy, Mel-chior Wathelet, presented his equip-ment plan. The report, made by his administration, concluded that till 2017- 2018, under extreme winter conditions, temporary supply problems could occur if the three oldest reactors would be closed in 2015. Nuclear plant operator GDF-Suez/Electrabel stated clearly that they were not ready to invest in the necessary upgrades and back fittings of those old reactors if they would not get a life time extension approval for at least ten years. Finally, on July 4th, the minister council took the following decision:

  • The twin units Doel-1 and Doel-2 will be closed in 2015, after 40 years of operation as stipulated in the nuclear phase-out law. 
  • The lifetime of Tihange-1 will be extended with 10 years, till 2025. 
  • The four other reactors will be closed after 40 years of operation, as stipulated in the nuclear phase-out law : Doel-3 in 2022; Tihange-2 in 2023; Tihange-3 and Doel-4 in 2025.

The minister council also decided  to delete article 9 of the 2003 nuclear phase-out law, which stipulates that the lifetime of the reactors may be extended over 40 years “if the security of sup-ply is endangered”. The government argued that this will secure the nuclear phase-out calendar, so that no new lifetime extensions could be granted in the future. Furthermore the government decided to facilitate the investment 
in new flexible replacement capacity, especially thermal gas plants. Because of the lifetime extension of Tihange-1, the existing gas plants become less profitable. To compensate this, the government intends to subsidize new gas plants. It remains very questionable that de European Commission will allow this governmental support for new fossil plants. Furthermore, in an attempt to cut the electricity price, the gover-nment decided to place 1,000 MW of GDF-Suez/Electrabel's cheap nuclear capacity at the disposal of the other power companies. 

The anti-nuclear platform Stop Nuclear & Go Renewables, initiated by Green-peace Belgium, WWF Belgium, Bond Beter Leefmilieu Vlaanderen and Inter-Environment Wallonie, is not impressed by the governments decision, which looks like a typical Belgian compromise. By extending the lifetime of the 900 MW Tihange-1 reactor with ten years, investors in new and flexible production capacity like efficient modern gas plants or renewables, will be deterred. Why should they invest in new expensive production capacity, if they will have to compete with the cheap electricity of old reactors which have been written off already for two decades? By taking only 866 MW of nuclear capacity from Doel-1 and -2 off-line in 2015, the grid will still be dominated by nuclear base-load power, making it very difficult to integrate more renewable capacity into the grid.    

Tihange-1 is a second generation PWR, build in the early 1970's. An indepen-dent review of the recent EU stress tests performed on Tihange-1 concluded: 
“Both the probability and the potential consequences of a severe accident are relatively high, therefore the risk of Tihange-1 is unjustifiably high. Consi-dering all facts, we recommend to shut down Tihange-1 immediately.” (Antonia Wenish, Oda Becker: “Critical Review of the EU Stess Test Performed on Nuclear Power Plants.” Study commissioned by Greenpeace. Wien/Hannover, May 2012.) Some 840,000 peoples are living within 30 km from the Tihange NPP, including the cities of Liège and Namur. The German city of Aachen  (260,000 inhabitants) is at 60 km, the Dutch city of Maastricht (120,000 inhabitants) is at 40 km.

Criticism South Korean UAE contract
A news program has belatedly exposed the fact that the South Korean government agreed to provide a loan covering approximately half the construction costs for the exportation of a nuclear power plant to the United Arab Emirates. While the government explained that this was part of ordinary power plant export financing, controversy has been flaring up as this revelation couples with previous controversies over inflation of the order amount and the deployment of troops to the UAE as a condition for receiving the order. A Jan. 30 episode of the MBC program 'News Magazine 2580' revealed that in the process of signing a contract with the UAE for the power plant export in December 2009, the South Korean government agreed to provide a loan for approximately US$10 billion (7.25 billion euro) of the total order amount of US$18.6 billion through Korea Eximbank. In addition, the program reported that the repayment period was set at 28 years, and that the transaction generates a loss due to the fact that South Korea, which has a lower credit rating than the UAE, has to borrow the money at high interest rates and lend it at low interest rates. The program also reported that the construction has encountered setbacks, including a delay in the groundbreaking ceremony from its originally scheduled date in late 2010, as the Korean government has encountered difficulties coming up with the promised US$10 billion loan.

The Uranium Film Festival wants to inform especially the Brazilian and Latin American societies and stimulate the production of independent documentaries and movies about the whole nuclear fuel cycle, about the dangers of radioactivity and especially about the environmental and health risks of uranium exploration, mining and processing. The Uranium Film Festival will be held from May 21th to 28th 2011 in the city of Rio de Janeiro and from June 2nd to 9th in the city of São Paulo

Germany: Complaints against runtime extensions to Constitutional Court.

In cooperation with citizens living close to Germany's seven oldest nuclear powerplants, Greenpeace has submitted a complaint to Germany's Constitutional Court (Bundesverfassungsgericht). While Greenpeace Germany generally argues that the runtime extensions endanger each citizen's right of being protected against bodily harm, the new constitutional complaint is specifically directed at the latest Nuclear Energy Law's paragraph 7d. The new §7d tells reactor operators, in rather poetic language, to reduce risks threatening "the population". This is, according to Greenpeace's law experts, a significant point. It means that individual citizens who have lately filed complaints (with support from Greenpeace) against the extension of the licenses for reactors in their neighborhood will be denied the right of action. In other words, the old Nuclear Law was designed to protect citizens and gave them the right to complain in local courts against the risks caused by the local polluter, and the new law withdraws this right.

Parallel to Greenpeace's action, two other complaints against the new Nuclear Law

will be filed at the Constitutional Court later this year. One is by a number of states of the German federation and the other is by groups of members of the federal parliament.

Norway: severe consequences of Sellafield accident.
An accident at the high-activity liquor storage at Sellafield would have severe consequences for Norway's wildlife, agricultural industry and environment. The Norwegian Radiological Protection Authority has published a second report on the consequences of a accident that releases just one per cent of the high-level liquid waste at Sellafield. This report looks at the consequences to the environment and animals, while the first report considered the fallout likely from a similar accident. The report use the typical weather experienced in October 2008 and only considers the release of caesium-137. An actual accident would release other radionuclides, particularly strontium.

It is estimated the amount of caesium-137 deposited on Norway would be about seven times that from Chernobyl. Direct costs from Chernobyl on agriculture and reindeer in Norway have been over 665 million kroner (US$118 million; 86 million euro) and there are still annual costs of 15 million kroner. Up to 80 per cent of all lambs in Norway would be expected to have excess radiation levels and restrictions apply for decades. The report is available at www.nrpa.no/dav/0942d3dc93.pdf

Canada: White Elephant 'Pointless Lepreau' reappears in New Brunswick.
The Point Lepreau nuclear generating station provides the quintessential definition of a white elephant. The aging nuclear plant opened its doors three times over budget in 1983. The Energy and Utilities Board refused to support spending on refurbishing it beyond its expected lifetime, but politicians went ahead anyway. Today, costs for the touch-and-go overhaul are already over Cdn$1.4 billion (1.4 bn US$, 1 bn Euro). The latest guess at a completion date is May 2012, a delay of almost three years. Damage to public and worker health and the environment have yet to be calculated and the final costs for taxpayers may not end for generations.

An alliance of public interest groups in New Brunswick, known as the Point Lepreau Decommissioning Caucus, is spreading a simple, but powerful message: Point Lepreau is a white elephant, we don't need it. Pointless Lepreau is old, sickly and on its last legs: Do Not Resuscitate. To underline the foolishness of refurbishing Lepreau, the groups are holding surprise events featuring their newest member, an actual white elephant costume aptly named Pointless Lepreau.

When the dust settles.
The International Coalition to Ban Uranium Weapons (ICBUW) and IKV Pax Christi have been working on a joint project to create an animated short film on the hazards of depleted uranium and the international campaign against its use and are happy to announce that the English language version has now been completed. We have sought to render down a complex issue into six and a half minutes and at present the animation is available in English and Dutch, we hope that additional languages will be available in future.

UK Gov't sending papers down the memory-hole. The UK government and its agencies like the Nuclear Decommissioning Authority (NDA; successor to Nirex) are trying to airbrush out the history of the attempt to find a nuclear waste repository in West Cumbria. Documents and scientific papers which were formerly available on their websites have been removed; the Nirex documents have been transferred to the safe keeping of the British Geological Survey, where they may be 'consulted' at Keyworth, Nottinghamshire. But nothing remains online, not even an index of the documents and reports. Now, David Smythe has re-scanned much of the material and collected links of other parts.

Sellafield (West-Cumbria) was disqualified for several reasons, but now NDA and government is looking again at that region for final disposal.

Monju: accident delays startup with 3 more years. The task of removing a device that accidentally fell into the prototype fast-breeder reactor Monju in August will delay its full startup about a year to 2014 or later.
The Japan Atomic Energy Agency, the operator of the 280 MW Monju reactor in Tsuruga, Fukui Prefecture, is expected to remove the device next summer or later and then conduct checkups, delaying the test operation initially scheduled to start next spring and subsequent full-fledged run. Removing the 3.3-ton device, which was used for fuel exchange before it fell into the reactor vessel in the Aug. 26 accident, requires special equipment, approval from the Nuclear and Industrial Safety Agency under the Ministry of Economy, Trade and Industry and a followup inspection.
Monju resumed operations with limited power output in May 2010 after 14 years and five months(!) of suspension due to a sodium coolant leak and a resultant fire and coverup attempt in 1995.

Extended operation for Paducah enrichment plant? US uranium enrichment company USEC said that it is working to extend the operation of its Paducah plant in Kentucky beyond May 2012, when the old and inefficient gaseous diffusion plant had been expected to shut down. The company said that it will "base its decision to extend operations upon economic considerations and the ability of the plant to operate profitably." The Paducah plant – currently the only operating uranium enrichment facility in the USA - is set to be replaced by USEC's planned American Centrifuge Plant (ACP) project in Piketon, Ohio.

The full ACP plant was originally expected to commence commercial operation in early 2010 and achieve full annual capacity at the end of 2012. However, early in 2009 the whole project was slowed pending funding through the Department of Energy (DoE) loan guarantee program, and in July 2009 it was suspended due to the DoE refusing to award a US$2 billion (1.5 billion euro) loan guarantee, and asking USEC to withdraw its application. USEC refused to do this, and in July 2010, it submitted an updated loan guarantee application to the DoE. In October 2010, DoE informed USEC that it has largely completed its initial technical review of USEC's application and is proceeding to the next stage of the loan guarantee process.

Although USEC earlier secured investment of U$200 million from Toshiba and Babcock & Wilcox to support the ACP, the company maintains that additional financing is needed to complete plant construction.

Italy: referendum on relaunching nuclear power.
Italy's constitutional court ruled on January 12, a national referendum could be held against the construction of nuclear power plants, dealing a potential blow to government plans to relaunch the sector. Prime Minister Silvio Berlusconi wants nuclear plants to generate a quarter of the country's electricity in the future. The court allowed a request by opposition politician Antonio Di Pietro for a referendum, which will take place between on a Sunday between April 15 and June 15.

Antonio Di Pietro is leader of Italia dei Valori (Italy of Values) a centrist political party and an outspoken opponent of nuclear power. An April 2010 petition by the party successfully gathered the 500,000 signatures of Italian voters needed for the referendum to proceed through the Italian legislative system. This was presented to the Constitutional Court for it's final ruling on the admissibility of the proposed referendum.

Public opinion in Italy has been generally hostile to nuclear energy, and a 1987 referendum following the Chernobyl disaster in Ukraine in 1986 closed all plants and phased out production.

Peligro nuclear: new law removes 40 year npp operating life limit

The Spanish government has ratified a law removing a statutory 40-year limit on nuclear power plant operating life.
The wide-ranging Sustainable Energy Act, known by its Spanish acronym LES (Ley de Economía Sostenible), was approved by 323 votes to 19, with one abstention, in the lower house of the Spanish government on 15 February. The amendment on nuclear energy within the LES was approved by 334 votes to 10, with no abstentions. The law had already passed through the upper house.

The nuclear energy amendment states that the government will determine nuclear's share in Spanish generation and also the lifetimes of existing nuclear plants based on a variety of considerations including regulatory requirements for nuclear safety and radiological protection as advised by the Spanish nuclear regulator, plus trends in demand, the development of new technologies, security of supply, costs of electricity production and greenhouse gas emissions.
Previous legislation imposed a 40-year operating life on Spain's nuclear reactors, which would have seen all of Spain's eight operating reactors facing closure between 2011 and 2018. However, in 2009 the Spanish government granted a four-year life extension to the Garona nuclear power plant, extending its life to 42 years and signaling the start of a political shift from earlier plans by the ruling PSOE (Socialist Party) to progressively phase out nuclear.

'Peligro nuclear'

'Nuclear Danger’ is the message Greenpeace Spain took to the country’s Cofrentes nuclear energy plant on February 15, as activists scaled one of the plant’s cooling towers. Greenpeace are demanding that Spain’s Nuclear Security Council refuse to renew the plant’s permit to operate - which expires on March 19 – because of the extremely poor levels of security at Cofrentes. The aging Cofrentes reactor is in bad shape. It has an endless list of bugs and unresolved security issues. Among the many weaknesses it has identified, Greenpeace has expressed concerns about the fire-fighting systems, access to the control room, the increasing radioactivity received by maintenance workers, and delays in the analysis of events and incidents.

Meanwhile, take a look at the renewable energy sector in Spain. According to a study by the Institute for Energy Diversification and Saving of Energy released in November last year, the number of current direct jobs provided by the renewables industry is more than 75,000. Taking into account the official renewable growth forecast, Spain can expect to see a further 128,000 created by 2020. On the other hand, the nuclear sector in 2005 had just 4,124 employees, of which 52.8% were the permanent staff at nuclear power plants. Spain is a leading nation when it comes to the production of renewable energy. It is showing we can live in a world without nuclear energy.

SIX CANADIAN REACTORS TO CLOSE IN TEN YEARS

The six nuclear reactors at Pickering would be closed down permanently in 10 years time, according to a new plan put forward by Ontario Power Generation (OPG).  Meanwhile, the four nuclear reactors at Darlington would be refurbished to extend their lifetime until 2050.  Whether a new reactor would be built is still uncertain.

WISE Amsterdam - Canadian OPG (Ontario Power Generation) announced that it will spend Can$300 million (US$284m or 210m Euro) to keep the Pickering [B] nuclear station open for another decade before it's mothballed, and will spend an undisclosed amount to refurbish the Darlington nuclear station. Darlington supplies about 20 per cent of Ontario’s power, with Pickering at roughly 15 per cent. Pickering is divided into the older “A” plant, where two of four reactors are still operating after recent upgrades and two others are shut down, and four reactors at the newer “B” plant, which is nearing the end of its operating life and needs modernization to keep going. The four Pickering A reactors were shut down in 1997 (along with three of the four Bruce A reactors) to allow time for the nuclear division of Ontario Hydro (as it was then called) to deal with thousands of unresolved safety-related maintenance problems that had accumulated.

Six years later, the decision was made to restart the four Pickering A reactors.  The entire restart was to cost Can$800 million and take about six months. But after Can$1,200 million and 18 months of effort, only one of the four reactors (Unit 4) was successfully restarted. After much angst, further delay, and another billion dollars, a second Pickering A unit was restarted (Unit 1). At this point it was decided to mothball Units 2 and 3 of Pickering A permanently.  The two restarted reactors have been operating poorly, producing only about 60 percent of their rated electrical output. Thus, after spending over two-and-a-half times as much money as projected for the entire Pickering A restart project, only  30% of its electrical output was restored. For Pickering B, an environmental assessment has already been done and the commission is completing its end of the safety review. OPG said it’s not cost-effective to do a full refurbishment at the Pickering plant because of its smaller reactors and older, first-generation CANDU design. The four reactors in the Pickering A plant were designed in the 1960s and came on stream in the early 1970s, with the four in Pickering B dating to the early 1980s. Critics and anti-nuclear activists have long been after the original owner, Ontario Hydro, and its successor company Ontario Power Generation, to close Pickering because of all the troubles, related high-costs and concerns over safety. Anti-nuclear activists likely will be pleased at the prospect of the plant's closing but question why it won't happen sooner. The answer is partly simple; jobs. Ontario has about 12,000 high-paying jobs dependent on the nuclear industry, because it cannot create enough jobs to replace those before 2020.

Costs Darlington unknown

An environmental assessment for the refurbishment at Darlington would be required, along with a safety review by the Canadian Nuclear Safety Commission to define how extensive the work would be and better pin down costs. The next phase of the process will include Integrated Safety Review and an Integrated Improvement Plan that will define the scope, cost and schedule of the refurbishment project. “The key to a successful refurbishment is having a clear understanding of the scope and cost of the work we need to do well before we start construction,” said Bill Robinson, Executive Vice President Nuclear Projects of OPG. Rough, very preliminary estimates indicate refurbishment of Darlington's four nuclear reactors, to extend their generation capability to about 2050, will cost Can$6 billion to Can$10 billion, said Ontario’s Infrastructure and Energy Minister Brad Duguid

Opposition New Democrats said either the government and Ontario Power Generation were guessing at the estimated cost of the nuclear refurbishment, or were withholding the figures from the public. “People should know what the costs are and what the estimates are.  You don't make a multibillion-dollar decision based on a guess''. Darlington didn’t come on line until the early 1990s and has been the most reliable plant at OPG, producing power 94.5 per cent of the time in its best year, 2008.

Ontario’s Premier Dalton McGuinty said that Ontario “remains on track to keeping half of its electricity generated by nuclear power plants”.  Last year, the government abruptly postponed a decision on building another nuclear plant at Darlington because the best of three bids, from Atomic Energy of Canada Ltd., came in at what then-energy minister George Smitherman termed “many billions” of dollars more expensive than expected. OPG now announced that it “continues to proceed with work that supports the construction and operation of a new nuclear station located at the Darlington site. The Environmental Assessment and site license work for a potential new build will continue in parallel with the above investment activities”.

“OPG’s announcement shows the cost estimates used to justify this government's commitment to nuclear power are not credible at all, and we should be revisiting the 2006 commitment to keep nuclear at 50 per cent of the supply over the long term. It'll bankrupt us if we implement that plan'' said Greenpeace energy watchdog Sean-Patrick Stensil.

U.K. wants to sell Urenco stake.
The U.K. Government’s stake in Urenco, which owns nuclear enrichment plants in Britain, Germany and the Netherlands, will be sold off to help to repay the country’s escalating debt mountain, the Prime Minister announced on October 12. The plan to sell off the Government’s one-third stake in Urenco could be the most controversial. The stake is controlled by the Shareholder Executive, which was created in 2003 to better manage the Government’s performance as a shareholder in businesses. The other two thirds are owned by the Dutch Ultra-Centrifuge Nederland and German Uranit. Downing Street sources said that the sale would be subject to national security considerations, which could lead to the Government maintaining a small interest in the company or other restrictions placed on the sale.

Meanwhile, the Dutch state took over the last 1.1% of the stakes in Ultra-Centrifuge Nederland, the Dutch part of Urenco, from private companies. Now, The Netherlands, owns the full 100% of the company. The Netherlands is not in favor of selling the uranium enrichment company to private parties.

Belarus: EIA Hearing new NPP.
On October 9, a public hearing took place in Ostrovets, in the Grodno Region, on the question of construction of a nuclear power plant in Belarus. All the entrances to the cinema where the hearings were held got blocked by riot police and streets were filled with plainclothes police. Documents and leaflets critical of the EIA (Environmental Impact Assessment) were confiscated illegally, because of their 'doubtful' contents. Employees of state institutions were brought to the hearings by busses. Forcedly assembled audience was registered in advance, in violation of regulations. Many registered participants were however not let inside the building. Speaking was allowed only to state employees in favor of nuclear power plant construction, others were denied to speak. The denial was motivated by the fact that they supposedly have been registered too late. It is clear that the procedure of these hearings didn't meet the standards and therefore the results can't be recognized as independent. Russian expert in nuclear physics Andrey Ozharovskiy was arrested in the morning on a charge of disorderly conduct when he wanted to enter the building and handing out a critical response to the EIA. He was released only after 7 days in jail. Thus, the authorities showed their true face again - they are not going to let the dissident speak openly on the matters important to those in power.

Sellafield: Dramatic rise to discharge limit.
Sellafield Ltd is expected to ask the U.K. Environment Agency (EA) for an almost 5-fold increase in gas discharge limit for Antimony 125 (Sb-125) so that the Magnox reprocessing plant can continue to operate. Sb-125 has a radioactive half-life of 2.75 years and emits beta radiation.

Disclosed in its Quarterly Report to the local West Cumbria Sites Stakeholder Group meeting scheduled for 1st October, the EA confirms that Sellafield wants the limit to be raised from its current level of 6.9 to Gigabequerels (GBq) to 30GBq. The bulk of Sellafield’s Sb-125 gas discharges arise during the de-canning  (removal of the fuel’s outer casing) of spent Magnox fuel, particularly the higher burn-up fuel, in the site’s Fuel Handling Plant prior to its transfer to the reprocessing plant.

In early 2008 the Sb-125 discharge limit stood at just 2.3GBq but later had to be raised to its current level of 6.9GBq when the discharge chimney sampling equipment was found to be under-reporting. In October 2008 Sellafield Ltd indicated to the EA that, as part of its Periodic Review submission, it would be seeking to increase the limit from 6.9GBq to 11.6 GBq. In a spectacular misjudgment of its discharge requirements, Sellafield now needs to raise the limit to 30GBq to allow the de-canning and subsequent reprocessing of the larger volumes of higher burn-up fuel being received in the Fuel Handling Plant from UK’s Magnox power stations.

Since 2007, processing higher burn-up fuel in the Fuel Handling Plant has lead to Sellafield breaching its discharge Quarterly Notification Level on a number of occasions, and in late 2008 exceeding the site’s internal trigger level. Subsequently, in April this year, as releases of Sb-125 from the Fuel Handling Plant threatened to breach the Sellafield site limit itself, Magnox reprocessing had to be abandoned for several weeks. Currently, the EA expects the current discharge limit to be breached again but is permitting Magnox reprocessing to continue – as the lesser of two evils.

The proposed increase in site discharge limit to 30GBq is unlikely to be authorized until April next year when approval from the European Commission, under Euratom Article 37, is expected to be given. Whilst the current limit of 6.9GBq is likely to be breached between now and then, it is understood that discharges of other fission products released during the de-canning of Magnox fuel in the Fuel Handling Plant, whilst also on the increase, will remain within their respective site discharge limits

Ratings NEK downrated due to Belene.
On 5 October, according to the Platts News Flashes, the rating agency Standard & Poor's Rating Services down rated the credit ratings for Bulgaria's dominant state power utility NEK from BB to BB- partly because of its involvement in Belene. The down rating "reflects our view of a weakening of NEK's financial profile and liquidity on the back of large investments and in the context of a deteriorating domestic economy," said S&P credit analyst Tania Tsoneva. The spending that NEK did "prior to the project's financing, coupled with large regular investments, have significantly weakened NEK's financial metrics". In November there will be an update of S&P's CreditWatch.

U.A.E. Passes Nuclear-Energy Law.
On October 4, the United Arab Emirates issued the Federal Law Regarding the Peaceful Uses of Nuclear Energy. The law provides for "the development of a robust system for the licensing and control of nuclear material." Federal Law No. 6, which was issued by U.A.E. President Sheikh Khalifa bin Zayed Al Nahyan, establishes the independent Federal Authority of Nuclear Regulation to oversee the country's nuclear energy sector, and appoints the regulator's board. It also reiterates the U.A.E.'s pledge not to domestically enrich uranium as part of its plans to build nuclear power plants, the first of which is slated for commercial operation in 2017. The law makes it illegal to develop, construct or operate uranium enrichment or spent fuel processing facilities within the country's borders.

The bilateral agreement for peaceful nuclear cooperation between the U.A.E. and the U.S., or the 123 Agreement, could come into force at the end of October, when a mandatory 90-day period of Congressional review is expected to end.

Uranium waste: Urenco transports to Russia stopped.
A TV-report by the German/French-TV-station ARTE brought a new wave of media coverage concerning uranium waste transports from France and Germany to Russia. One of the positive results of the media interest: Urenco has confirmed that the UF6-transport from Gronau to Russia on 26 August was indeed the last one!

This is a major success for the joint campaign involving Russian, Dutch, French, Finnish, Swedish and German activists and organizations for the last three-four years. Thanks to this hard campaign the anti-nuclear groups have finally stopped this part of the dirty export of nuclear waste to Russia. Considering that they were up against several of the biggest nuclear players in Europe and various governments they have done very well!

But the same documentary, aired on October 13, made clear that France’s energy giant EDF is still sending its uranium hexafluoride to the Seversk facility in Siberia, Russia. According to the ‘Liberation’ newspaper, 13 percent of French radioactive waste produced by EDF could be found in the open air in the town in Siberia to which access is forbidden. An EDF spokeswoman declined to confirm the 13 percent figure, or that waste was stored in the open air, but confirmed EDF sends nuclear waste to Russia. Because a small part (10-20 %) of the depleted uranium is send back after being enriched to natural levels U-235, authorities claim it is not waste but raw material.

Bad news for American Centrifuge Plant.
On October 15, the U.S. Department of Energy (DOE) announced it could not support a program to prove USEC’s centrifuge technology. The loss of US$30 million (Euro 20 million) for the next financial year comes after the DOE's July decision to refuse USEC a loan guarantee to help it secure finance for the American Centrifuge facility at Piketon, Ohio. At the time the company said it would have to 'demobilize' the project, on which it had already spent US$1.5 billion (see Nuclear Monitor 691, 16 July 2009, In Brief). The DOE placed USEC's application on hold and gave the company a chance to improve its application by proving the commercial viability of its technology. The DOE was to financially support a proving program with US$30-45 million per year, starting in the financial year 2010.

However, the US$30 million for the first financial year was recently denied by Congress during the appropriations process. And in another piece of bad news for USEC it has emerged that a manufacturing fault in its centrifuges will mean several months' delay while replacement parts are made and the units rebuilt. In a statement, the DOE noted that the deal with USEC still stands to postpone review of its loan guarantee application until certain "technical and financial milestones are met," which would probably take six months even without the delay of rebuilding. The department noted that it had "worked closely" with USEC this year on its loan guarantee application, and had put an extra $150-200 million per year into Cold War clean-up at an adjacent site managed by the company. This boost should lead to 800-1000 new jobs, the DOE said, which would offset the 750 jobs at risk on the American Centrifuge.

Jordan: site studies begin for Aqaba nuclear plant.
On October 13, the Jordan Atomic Energy Commission (JAEC) launched environmental and feasibility studies for the location of the countries’ first nuclear power plant. It marked the first gathering of the implementing parties of the site-selection and characterization study, a two-year process that will examine the proposed site, located in the southern strip of Aqaba, nine kilometers inland and 450 meters above sea level.

Over the next three months, nuclear engineering and consultant bureau’s, will determine whether the site, some 20km outside Aqaba city, will be suitable for the construction.

The JAEC selected Aqaba due to the abundant water sources of the nearby Red Sea and the proximity to infrastructure such as the Port of Aqaba and the electrical grid, the chairman said, noting that there are plans in place to establish up to six reactors at the site.

During the meeting on October 13, JAEC Chairman Khaled Toukan indicated that the JAEC is also considering a proposal to establish two power plants at the site simultaneously. The measure would decrease costs by 20 per cent through utilizing economies of scale, he added.

A week later Toukan announced that Jordan is coming up with 'strong results' indicating the country would emerge as a key exporter of uranium by the end of 2011. He made the remarks during a tour of the uranium exploration operations, which are being carried out in central Jordan by the French atomic energy conglomerate, Areva.

French Polynesia: nuclear compensation very restricted.
There was much praise in July when the French National Assembly approved a bill for compensating the victims of tests carried out in French Polynesia and Algeria over more than three decades. About 150,000 civilian and military personnel took part and many later developed serious health problems. (see Nuclear Monitor 686, 2 April 2009; In Brief) But now activists fighting for victims of French nuclear testing in the Pacific are stunned by conditions imposed in the compensation bill by France's upper house.

Roland Oldham, president of Mororua e Tatou Association, representing French Pacific nuclear test workers, said the actions of the upper house Senate reflected arrogance in metropolitan France towards its territories. He said the Senate has imposed strict requirements on applicants to prove their case on various grounds. The geographic zone from which claims would be considered had been greatly limited. The Senate had further rejected a bid by his organization - fighting for years for compensation - to be part of a compensation committee, which would now be only made of people nominated by the French Ministry of Defence. "It's the same people that have done the nuclear testing in our place, in our island," Mr Oldham said. "And finally, there's only one person decides if the case is going to be taken into account, (if a victim) is going to have compensation or not - and that's the Ministry of Defence. "For our Polynesian people it's going to be hard. A lot of our people won't be part of compensation."

Taiwan: life-time extension of oldest plants.
State-owned Taiwan Power Company has asked to keep using the oldest nuclear power plant, Chinshan, operational since 1978 in a coastal area of north Taiwan, after the licenses of its two reactors expire in 2018 and 2019, the Atomic Energy Council said. The application is for extending the life of the plant's two generators from 40 to 60 years. Environmental activists voiced severe concerns about what they called a risky plan, also citing a shortage of space to store the nuclear waste. “We strongly oppose the measure. We cannot afford taking such as risk," Gloria Hsu, a National Taiwan University professor, told AFP.

Taiwan Power operates three nuclear power plants, while a fourth is being constructed.

German court forbids longer running times for older nukes

Good news from the highest administrative court in Germany: The country's two oldest nuclear power stations are not allowed to extend their operation. Anti-nuclear groups are likely to rejoice. This decision makes it even more likely that all nuclear power stations in Germany will stop operation in a bit more than a decade, as in the corresponding law.

The ruling by the Federal Administrative Court in Leipzig concerns the power stations at Brunsbüttel, about 90 kilometers from Hamburg at the mouth of the Elbe River, and Biblis A, about 60 kilometers from Frankfurt. Hamburg is Germany's second-largest city with about 1.7 million people, Frankfurt its fourth-largest with 650,000.

Block A in Biblis was the first nuclear power plant in the then West Germany, starting operation in 1961. Brunsbüttel started up in 1976. Both nukes have a history of mishaps, including near-meltdown at Brunsbüttel. Biblis has the dubious reputation of being a "junkyard reactor" because of the frequency of its breakdowns.

The Leipzig judgment, handed down on 26 March, 2009, confirmed those of lower courts and rejected complaints by the power companies operating the plants. The owners wanted to achieve longer running times by transferring the remaining output quota of another station to these two.

There is tension in the fractious coalition government of conservatives and social democrats over a past government's law (the 2000 Phase-out law) to close down all German nuclear power production in about ten years. According to the German Ministry of the Environment (BMU), Biblis A has some 180 operational days to go ('Restlaufzeit').

Because Brunsbüttel is out of operation since an accident in July 2007 the closure, originally planned spring 2009, is now set far beyond the September general elections (actually 2012). Neckarwestheim-I will likely be the next one to be closed and has some 320 operational days left. According to the phase-out law, the last of the 17 nuclear power plants has to shut down in 2022. The power industry is lobbying hard to have the law overturned and is backed in this by Chancellor Angela Merkel, a conservative. Nuclear power will be an important issue in the coming national elections late September. On September 5, three weeks before the elections, a nation-wide antinuclear demonstration is planned in Berlin. The demonstration is also to commemorate the 'Tractor-treck' 30 years ago, when farmers from the Wendland-region traveled to Hannover (the capital of Lower Saxony) to protest the plans for a reprocessing plant, a nuclear fuel plant, an interim storage and a final disposal-facility at Gorleben. In Hannover, five days later, 100,000 people joined the farmers in one of the largest anti-nuclear demonstrations in Germany.
